    By accessing this web site, you are agreeing to be bound by these web site Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this web site are protected by applicable copyright and trade mark law.

    Permission is granted to temporarily download one copy of the materials (information or software) on PC Warehouse's web site for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

    Your privacy is very important to us. Accordingly, we have developed this Policy in order for you to understand how we collect, use, communicate and disclose and make use of personal information. The following outlines our privacy policy.

Sales, Refund, and Exchange Policy

  • STORE PRICING NOTICE: We offer both a card and cash price for all goods and services. Thank you for your patronage. Dual Pricing Services Provided By Axepay™. For more information, call: (877) 429-3729
  • Card transactions including but not limited to (VISA, Mastercard, Discover, American Express, Google Pay, Apple Pay, Samsung Pay) have a 3.99% transaction fee. To make things simple, we list/quote a single price with the 3.99% card fee included. At the time of transaction we discount our sales and services 3.99% to cancel out the 3.99% card transaction fee. Other transactions such as cash, ACH, etc. will still benefit from the dual pricing with the 3.99% discount.
  • We do not accept checks.
  • Receipt must be present for return or exchange.
  • Unopened merchandise qualifies for full refund within same day as purchase regardless of transaction type.
  • Unopened merchandise may be returned within 7 calendar days of the receipt date with a restocking fee of 3.99% for card transactions unless exchanged with an item of equal or greater value.
  • Opened merchandise returned within 7 calendar days is subject to a restocking fee of 20% for card transactions (16% for cash).
  • All sales are final for the following: Services and labor fees, Software (Ex: Operating systems, antivirus, etc.), Special Order Items including Deposits for such items (Items we don't normally stock such as laptop parts for example), Discontinued and New Old Stock (NOS) items, Items that have been purchased over 14 calendar days ago.

Warranties and warranty information

  • New complete custom built desktop systems: 1 year Limited parts and labor hardware warranty.
  • New laptops, all-in-ones and prebuilt desktop systems: 1 year Limited hardware warranty.
  • Partial systems and Bare Bone systems (Systems where 1 or more parts are supplied from a source other than PC Warehouse in Freehold): PC Warehouse sourced parts have a 30 day limited hardware warranty within PC Warehouse. Individual hardware components may have manufacturer warranties beyond the 30 days in which the customer will have to contact the manufacturer for any warrantied items. Outside sourced items (AKA customer supplied items) are not warrantied through PC Warehouse.
  • Previously owned systems: 30 days limited hardware warranty.
  • PC Warehouse warranties all new hardware for 30 days only. After 30 days, customer has to contact the manufacturer(s) for warranty(ies).
  • PC Warehouse warranties all repaired parts for 30 days only.
  • Software and software related services are not covered under any warranty.
  • Warranties are voided in the event any of the following occurrences: Physical Damage, Liquid Damage, Failures due to maintenance neglect, Overclocking or otherwise making hardware perform outside of the manufacturer recommendations, Failures and/or damages due to installation of faulty hardware.
  • Items that require disassembly for repair and/or data recovery may void any manufacturer warranties on these items.

Computer Service Agreement

  • It is the sole responsibility of the customer to backup any and all data and/or software programs and/or saved login credentials (usernames and passwords) before leaving computer for service.
  • Formatting a storage device (ex. Hard Drive, Floppy, USB) will cause all data on that device to be erased.
  • The customer acknowledges and understands the fact that some or all data and/or software and/or drivers for external devices (such as printers) could be lost during an automatic software update, manual software update, hardware upgrade and/or repair.
  • The customer understands that problems could arise during service and are not the fault of PC Warehouse but are coincidental and could surface when a previous problem is corrected.
  • Customer is responsible for providing all program software, validation keys, and/or login credentials upon operating system installation. (Including MS Office)
  • Customer is responsible for maintaining a record of their own login credentials for new accounts created with the assistants of PC Warehouse staff and/or technicians. For security reasons, PC Warehouse does not keep such information on file.
  • All items opened may void all manufactures warranties.
  • At the time of pickup, the serviced computer will be powered on and presented to the customer. This allows the customer to verify that the computer powers on and the issue(s) is/are resolved. The customer understands that by paying for services and claiming the serviced computer, they agree that the issue has been resolved. In the event the issue is not resolved, the customer has the option to leave the computer for additional diagnosis by not claiming it.
  • The Customer understands some or all programs and/or external hardware (such as printers and wireless connections) may need to be reinstalled and/or reconfigured to work with the new configuration (such as a clean install of the operating system).
  • PC Warehouse is not and can not be held liable for lost data and/or software and/or saved login credentials that the customer failed to backup prior to service.
  • Equipment left will be finished by discussed date if possible. However, no guarantee is made to when item will be finished. Customers who pay for higher priority service levels will have higher priority over customers who pay for a lower priority service levels. All priority services have priority over customers who declined to pay for priority services (standard service).
  • PC Warehouse charges for labor on any repair, upgrade, or installation unless otherwise stated on repair receipt.
  • PC Warehouse Labor fees are non-refundable and must be paid in full at time of pick-up.
  • PC Warehouse Diagnostic fees are non-refundable and must be paid in full at time of drop-off. ($65 for Laptops, $65 All-in-ones and Apple Computers, $85 for Gaming/Graphic PCs, $50 for Desktops, $150 for Servers. Certain computer models such as iMacs and Surface may require a higher diagnosis fee to cover additional labor cost in such systems. Additional labor costs will be disclosed at time of drop-off.)
  • All special orders are non-refundable and can not be returned for a refund for any reason.
  • PC Warehouse warranties all new hardware for 30 days only. After 30 days, customer has to contact the manufacturer(s) for warranty(ies).
  • PC Warehouse warranties all repaired parts for 30 days only.
  • PC Warehouse will charge a $25 a week storage fee for any items left more then 90 days from the in-service date. PC Warehouse is not responsible for items left more then 90 days from in-service date. If customer does not pick up their property within 90 days of in-service date, they will relinquish their property to PC Warehouse as payment for service.
  • The customer agrees to notify PC Warehouse within 7 calendar days of pickup date if the repaired problem(s) return(s), otherwise PC Warehouse and/or its technicians will not be held responsible for the(se) problem(s).
  • Customer must present their service receipt with case ID number or sufficient identification in order to claim item(s) left for repair.

Data Recovery Service Agreement

  • I authorize PC Warehouse to provide data recovery services as required. I will not hold PC Warehouse, or its technicians responsible for any and all data losses related to repairs. I understand that given the nature of electronic data storage and recovery services, problems could arise and are not the fault of PC Warehouse but are coincidental and could surface at any time, even when a previous problem is corrected.
  • Storage devices will be identified using the following terminologies (Patient, Donor, and Destination) where patient refers to the drive requiring data recovery, the donor(s) refer to matching drive(s) with compatible parts to the patient drive and the destination refers to where recovered data will be transferred to.
  • No guarantee is made that any and/or all data is recoverable.
  • Formatting a storage device (ex. Hard Drive, Floppy, USB) will cause all data on that device to be erased.
  • Data recovery service will be finished by discussed date if possible. However, no guarantee is made to when the data recovery procedure will be finished.
  • All items opened may void all manufactures warranties. Hard drive analysis may void manufactures warranties.
  • All recovered data will be transferred onto a destination storage device. New hard drives and/or computers are available for purchase if you don't have a destination storage device. You may supply your own new blank hard drive or computer for a destination storage device. In the event that you supply a destination storage device with pre-existing data, PC Warehouse will not be held responsible for this data.
  • Problems with customer supplied storage devices could arise and are not the fault of PC Warehouse but are coincidental and could surface at any time, even after a successful data recovery. PC Warehouse is not responsible for pre-existing data on customer supplied destination and/or donor drive(s). In the event the destination drive fails, the customer can choose to open a new data recovery case for the failed destination drive.
  • Any supplied donor drive(s) if needed will no longer work due to part(s) being damaged by the patient drive during the data recovery procedure.
  • Data recovery service is not covered under any warranty, expressed or implied of merchantability or fitness for a particular purpose.
  • PC Warehouse will not be responsible for items left over 90 days. Any equipment left over 90 calendar days will become property of PC Warehouse and will be securely erased where possible and/or destroyed and disposed of to recover shelf space.
  • Customer will not receive the original patient hard drive after data recovery service unless requested. There will be an additional charge of $70 for patient hard drive requests to cover the labor cost of reassembling the drive.
  • Customer’s copy with case ID number or sufficient identification must be shown in order to claim recovered data and/or item(s) left for data recovery.
  • There is a charge for testing items in any condition.
  • Labor Charges, Priority Service Fees and Analysis Fees are non-refundable.
  • We are not responsible for lost data. It is the sole responsibility of the customer to backup any data on storage devices before being supplied to PC Warehouse as a destination storage device.
  • I agree to not hold PC Warehouse, its owners and technicians for any coincidental damages to include, but not limited to, business interruption or other liabilities that result from permanent loss of data, corruption of data or delayed delivery of recovered data. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PC WAREHOUSE AND/OR ITS TECHNICIANS OR OFFICERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE DATA RECOVERY SERVICES, WITH THE DELAY OR INABILITY TO USE THE RECOVERED DATA OR PRODUCT OF DATA RECOVERY OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR OTHERWISE ARISING OUT OF THE USE OF THE DATA RECOVERY SERVICES, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF PC WAREHOUSE OR ANY OF ITS TECHNICIANS HAVE BEEN ADVISED OF THE POSSIBILITY OF DAMAGES.

PCW Guardian Service Agreement (Applies only to enrolled customers)

    PCW GUARDIAN SERVICES AGREEMENT

    One-Year Term - Consumer Service Agreement

    This PCW Guardian Services Agreement (“Agreement”) is entered into between PC Warehouse (“Provider,” “PCW,” “we,” “us”) and the undersigned customer (“Customer,” “you”). By enrolling in PCW Guardian Services, Customer agrees to the terms and conditions below.

    1. SERVICE OVERVIEW

    PCW Guardian is a proactive, device-based computer maintenance and protection service designed to help keep compatible operating systems and software secure, monitored, and backed up.
    PCW Guardian is offered in three service tiers:
    • PCW Guardian Basic
    • PCW Guardian+
    • PCW Guardian Pro
    This Agreement applies to all tiers. Features vary by plan as described below.

    2. PLAN DEFINITIONS & INCLUDED SERVICES

    2.1 Services Included in ALL PCW Guardian Plans
    • Automated system performance monitoring
    • Operating system and compatible software updates
    • Security patch management
    • Local image and file backup using a customer-supplied external hard drive
    • Automated backup scheduling (default 5:00 PM daily)
    • Remote access setup for enrolled devices
    • Priority in-store service over non-members

    Backup Scheduling Notice:
    If the computer is powered off at the scheduled backup time, backups will automatically run the next time the computer is powered on.
    2.2 PCW Guardian Basic
    Includes all services listed in Section 2.1.
    Does NOT include:
    • Antivirus software
    • Off-site/cloud backups
    • Annual dust-removal service
    • Free in-store diagnostics
    2.3 PCW Guardian+
    Includes everything in Guardian Basic, plus:
    • SentinelOne Next-Generation Antivirus
    • Off-site cloud backup with a base allocation of 1TB per enrolled device
    • Additional cloud storage available for purchase in 1TB increments
    • One optional annual dust-removal service performed during any in-store visit
    2.4 PCW Guardian Pro
    Includes everything in Guardian+, plus:
    • Off-site image backups preserving:
    ◦ Operating system
    ◦ Installed programs
    ◦ System settings
    ◦ User data
    • Free in-store diagnostics for enrolled devices
    • Accelerated recovery options in the event of drive failure

    3. DEVICE-BASED ENROLLMENT

    • PCW Guardian is sold per device, not per customer.
    • Each computer enrolled requires its own Guardian plan.
    • Customers with multiple devices must enroll each device separately.

    4. CUSTOMER RESPONSIBILITIES

    Customer agrees to:
    • Provide and maintain a compatible external hard drive for local backups
    • Keep the enrolled device powered on periodically to allow maintenance and backups
    • Maintain internet connectivity for updates, monitoring, backups, and remote access
    • Notify PC Warehouse promptly of alerts or backup issues
    • Understand that remote access requires the computer to be powered on and online

    5. LIMITATIONS & DISCLAIMERS

    5.1 No Hardware Coverage
    PCW Guardian does not include:
    • Hardware repair or replacement
    • Physical or liquid damage repair
    • Power surge or electrical damage
    • Manufacturer warranty services
    Hardware repairs are billed separately.
    5.2 Backup Limitations
    • Local backups rely on customer-supplied external drives
    • PC Warehouse is not responsible for failures caused by defective customer hardware
    • Off-site backups are subject to storage limits based on plan tier and add-ons
    • No backup system can guarantee protection against all data loss scenarios
    Customer remains responsible for verifying critical data.
    5.3 Software Compatibility
    PCW Guardian supports compatible operating systems and software only.
    Unsupported, end-of-life, pirated, or modified software may not be fully supported.

    6. SCAMS, SOCIAL ENGINEERING & UNAUTHORIZED ACCESS DISCLAIMER

    PC Warehouse and PCW Guardian Services are not responsible for damages, data loss, financial loss, or system compromise resulting from:
    • Customer granting access to their computer to third parties
    • Phone, email, pop-up, or text-message scams
    • Social engineering attacks where Customer is tricked into:
    ◦ Installing software
    ◦ Providing passwords, PINs, or verification codes
    ◦ Allowing remote access
    ◦ Approving actions under false pretenses
    Customer acknowledges that no antivirus, backup, or monitoring service can fully protect against scams where access is voluntarily granted by the user.
    PC Warehouse shall not be held liable for losses resulting from:
    • Customer actions or approvals
    • Customer authorization of third parties
    • Impersonation of PC Warehouse, Microsoft, Apple, banks, or other entities

    Important Notice:
    PC Warehouse will never initiate unsolicited calls requesting remote access, passwords, or payment information. Any such request should be treated as suspicious.

    7. SERVICE SOFTWARE, AGENTS & DISABLED SERVICES

    PCW Guardian services rely on the continuous operation of essential management, monitoring, security, and backup software components, which may include but are not limited to:
    • Remote monitoring and management (RMM) agents (e.g., NinjaRMM)
    • Antivirus and endpoint protection services (e.g., SentinelOne)
    • Backup, monitoring, and automation services
    Customer acknowledges and agrees that disabling, uninstalling, blocking, tampering with, or restricting these services--whether intentionally or unintentionally--will impair or fully disable some or all PCW Guardian services, including but not limited to:
    • Antivirus and ransomware protection
    • Local image and file backups
    • Off-site cloud and image backups
    • System performance monitoring
    • Automated maintenance and patching
    • Remote access functionality
    PC Warehouse is not responsible for service failures, data loss, security incidents, or system issues resulting from the disabling or interference of required Guardian software components. If essential services are found to be disabled, PC Warehouse may suspend Guardian services for the affected device until the issue is resolved. Restoration of services may require additional labor and may be billed separately.

    8. SERVICE TERM

    • This Agreement is for a one (1) year term beginning on the enrollment date
    • Services are billed monthly during the 1-year term
    • Pricing is locked for the term unless:
    ◦ Storage requirements change
    ◦ Additional services are added
    ◦ Payment method changes

    9. CANCELLATION POLICY

    • Customer may cancel service with 30 days written notice
    • No refunds are provided for partial billing periods
    • Failure to pay may result in suspension or termination of services

    10. PAYMENT AUTHORIZATION (RECURRING MONTHLY BILLING)

    Customer authorizes PC Warehouse to charge the selected payment method automatically each month for PCW Guardian services.

    11. ACH AUTHORIZATION

    Customer authorizes recurring electronic debits from the account provided during sign up.

    12. CREDIT CARD AUTHORIZATION

    Customer authorizes recurring charges to the credit card that was supplied during signup

    13. AGREEMENT UPDATES & TERMS OF SERVICE

    This Agreement is subject to change from time to time to reflect service updates, feature changes, pricing adjustments, or legal requirements.

    Continued use of PCW Guardian services constitutes acceptance of the most current terms.

    14. ACKNOWLEDGMENT & ACCEPTANCE

    Customer acknowledges that:
    • PCW Guardian is a maintenance and protection service, not insurance
    • No guarantee is made against all data loss or system failure
    • PCW Guardian services require approved management, security, and backup software to remain installed and enabled
    • Responsible computer use remains the Customer’s responsibility

Data Storage & Secure Data Destruction Policy

    Purpose

    This policy outlines PC Warehouse’s procedures for the temporary storage, secure handling, and permanent destruction of customer data associated with computer repair, data recovery, and equipment disposal services.

    Temporary Data Storage During Service

    • During certain repair, upgrade, data-related services, or software-related services, PC Warehouse may create a temporary backup of customer data to protect against accidental data loss.
    • These backups are created solely for service continuity and quality assurance.
    • Temporary backups are retained for up to three (3) calendar days after the customer has picked up their equipment and/or recovered data.
    • After this retention period, all temporary backups are securely and permanently deleted unless otherwise agreed to in writing.

    Abandoned Equipment & Unclaimed Data

    • Equipment and data storage devices left unclaimed after reasonable contact attempts may be deemed abandoned in accordance with applicable local and state laws.
    • Abandoned equipment may be recycled, disposed of, or destroyed at PC Warehouse’s discretion.
    • Prior to recycling or disposal, all reasonable measures are taken to ensure that customer data is permanently destroyed.

    Secure Data Destruction Procedures

    Functional Data Storage Devices
    For functional data storage devices (including but not limited to hard disk drives, solid-state drives, and flash storage):
    • PC Warehouse performs a full overwrite of the storage media with zeroes (0s).
    • The overwrite process is verified to confirm all accessible sectors have been successfully written, ensuring data is rendered unrecoverable.
    Non-Functional or Damaged Storage Devices
    If a storage device is damaged or inoperable to the extent that secure overwriting is not possible:
    • The device will be physically destroyed using methods such as, but not limited to:
    • Drilling through the drive platters or memory chips
    • Other industry-accepted physical destruction techniques
    • These methods ensure that data cannot be reconstructed or recovered.

    Customer-Requested Equipment Disposal

    • Customers may request that PC Warehouse dispose of unwanted computers or storage devices.
    • All customer-requested disposals follow the same secure data destruction procedures outlined above prior to recycling or disposal.

    Limitations & Customer Responsibility

    • PC Warehouse is not responsible for data left on devices beyond the stated retention period.
    • Customers are encouraged to:
    • Maintain their own backups prior to service
    • Retrieve their equipment and data promptly upon service completion
    • Once data destruction has been completed, recovery is impossible.

    Policy Updates

    This policy is subject to change without prior notice. The most current version will always be available on PC Warehouse’s website or upon request.

non-HIPAA Disclosure

    HIPAA Acknowledgment & Assumption of Risk

    Disclosure of Non-HIPAA Compliance:
    PC Warehouse is not a HIPAA-compliant service provider and does not act as a Business Associate under HIPAA. We do not enter into Business Associate Agreements (BAAs).

    Customer Acknowledgment:
    By submitting this form, you acknowledge that your device may contain protected health information (PHI), confirm you are authorized to release such data, and accept all HIPAA-related responsibility.

    Scope & Data Handling:
    Services are technical in nature. Temporary backups may be created and retained in accordance with our Data Storage & Secure Destruction Policy.

    Limitation of Liability:
    PC Warehouse is not responsible for HIPAA compliance, penalties, or regulatory obligations arising from your use of a non-HIPAA-compliant service provider.
